Taliban’s New Criminal Law: Men Permitted to Beat Wives and Children

According to Rokna, the Taliban government in Afghanistan has issued a new criminal code that interprets domestic violence as a form of “ta’zir” punishment, permitting men to strike their wives and children as long as it does not result in bone fractures or open wounds.

The British newspaper The Telegraph obtained a copy of this 60-page law, which bears the signature of Mullah Hibatullah Akhundzada, leader of the Taliban, and has been distributed to courts across the country.

According to media reports, the law sets a maximum imprisonment of 15 days for proving serious injury and requires the woman to appear before a male judge accompanied by a male guardian, often the husband himself.

The law also contains provisions that punish a woman who flees to her parents’ home without her husband’s permission with up to three months of imprisonment. It nullifies previous regulations that protected against domestic violence, a move that has sparked widespread human rights criticism.
